I've received a summons for a contempt hearing because I have not been able to keep up the payments on the house after my divorce. The house is going into foreclosure. I managed to negotiate a new mortgage contract last October but, because of unemployment, I haven't been able to pay anything except a fee and 1 mortgage payment of $1700. Now she wants to bring contempt charges against me. I've tried to sale the home also. She signed a Quit Claim Deed at the time of divorce. Mortgage is 8 years old. Am I in contempt even though I have made efforts to satisfy the mortgage? I plan on using the FHA to negotiate a Deed in Lieu of Foreclosure when all is said and done.

All you can do is explain to the judge you are doing the best you can. Why is she still in the house? Is the house and mortgage solely in your name? How long were you ordered to make payments for?
