Contest Traffic Ticket Citation Errors in Law Section

I recieved two tickets yesterday for the tint on my windows one for the drivers side and one for the passengers side. I am wondering after looking at the law, the cop wrote out the tickets for Article 9 Section 375 Subsection B1 and B2. Which are releted to having stickers on your windows which i don't have any. The tinting law which is Article 9 Section 375 Subsection 12-a and 12-b.

Is this a valid arguement that the ticket is in accurate because the subsection is incorrect?

Who Has To Correct What Now?

No!

You will shoot yourself in all 10 toes and hang yourself out to dry if you present such an "argument" in court, or any other venue for that matter that the "ticket is inaccurate because the subsection is wrong" as you will present the opposition with an opportunity to correct the mistake and proceed against you all dolled up chipper. And, they won't even have the courtesy to thank you for pointing that out.

"Your honor, the ticket is null and void and I move to dismiss the case as I do not have stickers on my windows as alleged on the citation," is the prudent thing to say and then step back and hold your peace. The judge will ask you for proof so take picture of your windows and have them ready for show and tell.

Remember, it is the People who have the burden of proof not you!

If nothing else, in the first court appearance you can get the second citation dismissed. They are written for the same violation for which you had no time to correct in between.

By the way... isn't this a fix-it ticket? Just correct the problem, have them inspect it, pay a small transaction fee, and be done! No court!
