We purchased a small resort on a contract for deed, in our contract we were to receive the previous years business records and clients list, which we never got. We were also told on the disclosure statement that the infloor heat worked, which it does not, were not able to rent out our pontoon because we could not license it because of no title (loss revenue), unpaid previous bills, that we had to pay to keep our electric on, and phone number from being changed. We have filed in small claims court for 7500 dollars. My question is, we have an annual payment due at the end of September for 18000, can we deduct the amount of claim we made at the small claims court. Our court date is not till February 2nd in Minnesota. Thanks
 
Since you don't know if you are going to win the case in small claims you should not deduct the amount from the payment due in September. Your case has so many red flags and I think you would be best served if you actually consulted with an attorney in your town to see what other options you have to resolve this issue. That is why you need an attorney to review what you signed for and to see what you received when it comes to the contracted terms. Best of luck to you!
