My husband is a small business contractor, not incorporated. He is being sued to the tune of $10,000. He was paid, but they say he was overpaid, he was not, but they have a lawyer, are a company w/accountants. My husband did a LOT of work for them and everything was on the fly, they were fine until the end when a number of things happened to their business and rumors about my husband's past (we think) came into play. Long story short. We go to court soon, have no lawyer and are uncertain of the outcome. We do not have that kind of money. If we lose, what can they do to us financially, what can we do to protect ourselves? My husband is an honest man and too trusting and the handshake has come back to bite him. Please advise! Also, would written statements from people help us or things like that?

If you lose (and your husband is not incorporated), your private assets can be taken as payment (i.e., bank garnishment, for example).

What written statements would other folks provide for you?

They would provide statements to defend that the work he had been paid for i.e., change in contract had been negotiated verbally and done. Another question, can they garnish MY wages? I work at a hospital. Can his business declare bankruptcy?
