I own a small business in WV. A company based in NY approached us to do snow removal services for a very large nationwide pharmarcy chain. All work in which we performed was done so as per contract specs. Now the contractor that we deal with does not want to pay us for services already done. My question is, Do we have a legal right to submit our invoices to the national chain for payment?

No, your contract was with the middle man.
The pharmacy chain owes you nothing.
Your claim is against the middle man.
Hire a lawyer ASAP.
It appears the middle man isn't going to pay you.
The middle man seems to have collected from the chain store.
Or, they might have trouble collecting form them.
You might end up eating this one.
That is why you shoudkl speak with a lawyer, ASAP.
The middle man might be in financial trouble.
If the middle man goes into BK, you get NOTHING.
Get a lawyer today and sue them!

Army, again I have to disagree with you here. The Contractor bears the main liability but I would certainly hit the Pharmacy with my invoices. I'm not necessarily saying that you would win in court against the pharmacy, although there is quantum meruit for services rendered that you could sue for. The Pharmacy would pay you just to keep it out of court. I can't imagine that your invoices are enough to make them want to hire an attorney to defend this case.

Besides that, the Pharmacy will turn around and put pressure on the Contractor to pay. I think involving the Pharmacy whether you can recover from them or not is your best path to getting paid.
