So I want to open up a restaurant bases around different themes like Marvle ie there is a Captain America Burger these are all inspired items based around the characters would I be able to call them by names or could I be sued for copyright infringement ?

Don't do it.

Wholesale appropriation of the name is not merely "inspiration." This is not, however, a matter of copyright. You'd get sued for trademark infringement, and you'd lose. Badly.

Simple rule: Don't try to profit off of the creativity of others.

The day you open.

Which will also be the day you close as Marvel will get an injunction preventing you from doing business.

You can try and buy a license from Marvel to use the characters and see how that goes.
