I just bought a counterfeit golf club from a guy on craigslist. It looked real, almost identical. When i got to the course and hit the club I instantly noticed it was a fake. I emailed the guy back and was very nice. I simply told him i knew it was fake. I told him i didn't want any trouble, and that i did not want to take any legal action. I asked him if we could meet up and make the exchange. I said "you give me my money back and i'll give you your club back and we can go on our way. All of his information is online. I know where he works, where his folks live, where he works, his girlfriend, EVERYTHING. He pretty much told me "dude you bought it, it's yours" All i want is my money back. I don't want to take legal action, but will if it's necessary or possible. He said he won it in a golf tournament. I've played in plenty of tournaments in my day and fake clubs are never prizes. Even if i don't get my money back he should be punished by the consequences. Any advice would be greatly appreciated.

Small claims is going to be very difficult, and often useless.
If he lives in another state, fuggedaboutit!!!

If he lives in Texas, you'll have to sue him in JP Court that sits in the place and precinct in which he resides.

That means you'll have to travel there several times, maybe.

But, even if you prevail in court, you don't get money.

You get a judgment.

Then you have to enforce the judgment.

The problem is that in Texas much of what he owns is exempt from attachment or levy to satisfy your judgment.

Maybe you just wanna take your lumps?
There is a lesson here.
If you buy online, buy only from reputable merchants and not online shysters, crooks, scammers, and con-artists!
Good luck!!!
