I was written a ticket for illegally handeling fireworks on July 3rd, 2005, the officer (actually fire captain) wrote my court date for August 28, which is a sunday, do I have to appear?

May be a mistake. You need to call who issued the ticket and find out what day he actually meant. I don't think they ever have court on the weekend. But if you don't call to find out the real date and you miss it you could be in trouble and might have to pay a bigger fine.

You can say that, and it might even get you out of the warrent for your arrest for not showing to the intended date, but it will not get you out of the original charges.

If you go on any normal court day, and the cop doesnt show, your free to go. So what makes this day different? Its not my fault the cop wrote it for the wrong day..

Straighten it out or deal with the consequences

What makes you think there is a loophole to keep you from having to appear? Minor mistakes on a ticket don't invalidate it.

A reasonable person would be expected to look at the calender, check the date and realize its a Sunday. A reasonable person would then be expected to call the courthouse and figure out what the court date actually is.

You can choose not to go, but the consequences which will follow are yours.
