I have a court date tomorrow and im being charged with petty theft but im scared of getting put back in jail. It was my first offence but it was $208 worth of stuff. Do the judges usually give jail time for first offences? Is there anything I can do or say to not get jail time? Im so scared of going to jail that I have thought about not going and I know I would get a warrant out for my arrest if I did that but if I got a warrant do the police come to my house looking for me or is it only if I ever get stopped by a police and they see it they automatically take me in?

If you do not go and a warrant is issued for your arrest, the police can come to your home, your place of business, or wait until you are contacted on the street. If some officer is bored, or they have the time, they may even check out the homes of family and friends to try and find you. You might get tired of friends telling you that the police are watching them because of you.

If you face up to it, you may well get off with some deferred entry of judgement plan that will entail fines, fees, and probation. But, it all depends on the laws in your state.

if you cannot afford an attorney, one should be appointed for you.
