I would like to ask a question. My wife and myself have been going through divorce for the last 12 months. Recently DCF became involved regarding my two children. They recently filed a shelter hearing under 24 hours. But when they took custody of my two children they ordered me out of my home taking my house key and without a court order. I understand they have emergency powers regarding the children. There were police at my home but they were confused why I was being told to leave as the DCF officer had no court order and said we will have it tomorrow 4/13. I'd like your thoughts on this.

DCF often bluffs, or as some would say, bullies people into submission.

Without a court order, you didn't even need to admit anyone, much less DCF into your home.

The police were present to keep the peace and protect DCF workers, maybe.

What can you do now, having voluntarily acquiesced to the demands of DCF?

You might want to speak to two or three lawyers in your county on Monday.
The initial consultation is usually at no charge.
Once you've done that, you'll know EXACTLY how bets to proceed.

They are all talk and no bite.
If there is something they want to do against your will they pretty much need a court order to pull it off. Otherwise you just keep saying no. People feel intimidated by the presence of the police, but the police should have kept a neutral position, which it seems maybe they did.
If there was never any court order there is nothing stopping you from returning to your home.
 
I was forced to leave the home handing my keys to the police. The point is they told me that there was a court order and there was not one issued till the following day. So removed me from my home without it being court ordered. Is that illegal ?

The best thing you can do is get the divorce resolved ASAP.

These days you can get a divorce completed within 30 days in most states.

While the matter is pending, stay away from yoru soon to be former spouse and the kids.

In some cases, people are vindictive and will do anything to pour more feces on the other party.

If I were you, because of this kerfuffle, you might want to have supervised visits witht he kids, and under no circumstances pick the kids up where their mother lives.

To avoid getting lied on AGAIN, make the exchange in a police station each and every time.

You love your kids, but you are the only one capable of looking out for yourself.

I'm confident that the police version of events would be that you left voluntarily, which is completely legal.
You knew there was no order and chose to leave and hand over your keys anyway.

The thing is the CPI told me that there was a court order. She also called 911 and on the call she told them too. The point is I would not have left
 
If there had been an order YOU would have been served with it before it could be enforced. I understand how this all made you feel, but when it comes down to it you left voluntarily.
 
Unless they actually showed the court order, I wouldn't have left. I wouldn't have given the key unless they showed me something signed by a judge that stated I had to leave.
