Craigslist nightmare!

Looking to hear some legal advice.

6 months ago, I bought a cellphone from Craigslist. The owner had given me a best-buy receipt and it felt legitimate. Long story short, I didn't like the phone and decided to flip the phone after a week usage. My ad stated the phone was like brand new with minimal signs of usage/fully functional and receipt will be provided. In the ad, I had not mentioned that I was the second owner as I felt it was unnecessary. Needless to say, the phone was sold in good faith and at that time the buyer conducted full inspection and found no trouble. Now the buyer has contacted me after 6 months and told me that the phone has been blacklisted and wants a full refund. As a result, I explained to him in email that I am the second owner and I had no intention of black-listing the phone and I am a victim myself. He demands, because of the non-disclosure, that I pay him full amount back or will take me to police/ small claims court despite the fact that I had nothing to do with black-listing the phone. He currently does not have my name nor my address; only my contact number and email. In BC, I heard a valid address with a legal name is required to submit a small claim- is this true?

Does he have a case?

You need an attorney Canada, I'm afraid.

And you might want to stop using a very old scam trick in the future. Eventually it's not going to end well for you.

Why not avoid trouble?
Stop buying junk off of CrapList and give dude back his money.
That's the easiest way to make this disappear.
As Pro advised, failing to fix it, could end up with the police knocking on your door.
They'll want to know how you acquired the phone.
They can discover the "ad" you claimed suckered you.
 
How much was the phone - probably not enough not to just give the buyer his money back & save yourself some problems.
 
I am not avoiding trouble; after having an initial discussion with the buyer- I had agree to give half back; which the buyer disagreed. I felt after 6 months of usage asking for a full refund back sounded unreasonable. The buyer accused me of black-listing the phone which I have nothing to do and I did not appreciate that. At that point it became beyond cash and I wanted to prove my innocence too as I felt I was also being victimized.

The overall the tone of the replies sounds as if I had suckered him into buying the phone which I don't believe to be the truth. Had I known the phone to be illegitimate, I would not have sold the phone but given that I had the receipt, I had every reason to believe that phone was a good one.

To reply to Army judge- The phone I purchased was through craigslist and I don't think it was a junk. I still have the ad from CL. And from the start, I had no intention of suckering this person into buying the phone.

Frankly, if you scammed the buyer, or gave him a great deal, NONE of my business.

I am nobody.

The people you need to convince, if he carries through with his threats wear badges and carry guns.
Then there's that man or woman that wears that fancy black robe.
If it gets that far, there will be that jury of six or twelve (in the States anyway), that will ultimately decide.

Either way, you vented, so I hope you're happy.

I don't take any of this personally.
We'll never meet, so it won't matter to me.
