In May 09, I spoke my credit card company to set up a payment plan and for the funds to be automatically withdrawn from my account starting in June. I received a letter dated May 30,09 confirming the payment plan and information of 0% interest, and they would credit my account over 2000 dollars by removing over the limit and late payment fees, etc. The payment was never withdrawn from my account and I was told once I called that my account was sold to a collection agency because after the person set up my account on the plan someone else in the office stated I filed bankruptcy which made ineligible to stay on the plan. I was given the number to the recovery department about the error made because (1) I never filed bankruptcy and (2) I never spoke with anyone else in the company after May 09 when we agreed on the payment arrangements and interest rate. I was told that my account was sold to this collection agency as of 6/18/09 and then recently told it was sold on 6/3/09. June 30, 09, I spoke with a rep who asked me to faxed in the letter confirming our agreement and she would have her supervisor review it and I should call back for the results. However, they are not assisting me when I call back and asking me to call the collection agency that they have sold my account to. However, I have not receive a call from the agency they sold my account to nor have I received a letter from the creditor or collection agency stating my account is no longer with the creditor but is now with the collection agency. I recently may the agreed upon payment to my account since it was not automatically withdrawn from my account although I had already scheduled the payments for one full year to be withdrawn from my account on a certain day each month. The creditor is now upset that I made the payment to them and I just found out by the creditor, the letter that I faxed to the creditor to confirm the payment plan was sent to the collection agency. Is the creditor able to void the agreement we made via a phone conversation that they later sent a message to confirm it? And should it be my responsibility to contact a collection agency before they make any contact with me?
