I am being harrassed for a payment that is 10 years old for a department store. I have not been contacted in 10 years and now a credit company from California calls me3-4 times per day. I offered to make a small settlement, but they would not agree. The total is $900.00, I offered $200.00. I am currently out of work and they know that. I have sent a Cease and Desist letter, but they continue to call. What more can I do?

Look up on the web Fair Debt Collection Law to see what a creditor may or may not be allowed to do. There should be a place to file a complaint. Also check out the statue of limitations (SOL) for your state on debt/credit card collections. Ask the people who are calling for their names and ask to speak to a supervisor, if he acts ugly, ask to speak to his supervisor. Repeat this every time they call. Also ask them for written proof of the original debt and charges.

What can I do to stop collection agencies calling for my 35 year old daughter that does not live here from calling me 10 times a day, even on a Sunday. I tell them she doesn't live her and to stop calling my # but they hang up and call back a minute later. I am sick of it. Is there a form I can write their name & phone # on and report them? Please advise. I've stopped answering my phone.

Call and tell them that you will also take action against them for violation of Federal law and demand to speak to a supervisor. Make sure to take names down. Tell them you are going to fax them a letter confirming that you will report them to the state attorney general and that they have been warned numerous times that the debtor does not live in your home. Then send that fax and keep the receipt confirmation!
