I live in a suburb of Dallas Texas and recently received two tickets. One for possession of tobacco (I'm 17) and another for alcohol.
I was carrying a small tin of pipe tobacco and an empty flask. The officer claimed it smelled like Jim Bean
. I smelled it, and to my surprise it indeed smelled like liquor (I rinsed it out with water earlier). But nothing like Jim Bean, or even whiskey for that matter.
Even more interesting the flask has never been anywhere near Jim Bean or whiskey. Aside from a few shots offered to me (see below) which I saw promptly consumed by a friend of mine never touching the flask.
A friend of mine on probation was recently caught stealing Jim Bean (repeatedly) from his guardians who told his probation officer.
He has a bad habit of telling them he is with me as his guardians have lost quite a bit of trust in the people he usually hangs out with (mostly because they steal there liquor).
There is no doubt in my mind that my name has worked its way to his probation officer more that a few times.
The officers seemed to have quite a lack of trust for me and my friends calling us all liars. Even the ones who where completely honest and presented contraband before it was even requested of them. They also had no problem expressing there opinions of out genoration. "I have no faith in todays youth."
In the following days I was stopped by police three more times and have see a heavily increasing number of crown vic's.
Is this officers negative opinion of me going to heavily affect the judges decision?
Can I receive a MIP for being in possession of something that smells of alcohol?
Will I ever get my flask back, it was a Christmas gift and holds memory's of my drinking days.
Will my license be suspended?
Is there a mandatory minimum in Texas for MIP fines?
How could I go about defending the alcohol charge.
Every one around here I know that is charged with drug possession seems to either get ridiculous sentences or nothing at all. IE two tabs of ecstasy, manslaughter. 1,000 Xanax, charges dropped (500 hundred showed up in court along with no warrant for the house which was raided).
Many people around me seem to point towards corruption and harassment, I haven't see it but over whelming public opinion around me suggests that I could get screwed over some how here. Is there any thing I can do.
