I have twin great-nephews(IA) that have been in foster care since they were 7 weeks old, the day they were placed into foster care I made phone calls to have them placed with me(NY), because they were going for reunification DHS/judge could not place them with us. I then proceeded to find how I can get them to NY, the casework started ICPC paperwork which she started 2 months after I first spoke with her, after many, many phone calls and emails between IA and NY finally I had a home study and all paperwork was done and sent back to IA. During this when boys were 7 months old state put in order for termination of parents rights, court dates were set and trial was held. My paperwork was approved by NY and just waiting to IA. At the second part of TPR trial case worker said she received ICPC for us but did not go over it yet. I called her 2 weeks later to see if she had gone over paperwork and if she is going to place boys with us(at this point boys are 10months old) she doesn't answer me, my case worker in NY calls her as well no answer. My ICPC will be expiring soon I needed an answer, finally month n half before ICPC paperwork expires IA caseworker tells me she can't place boys with us because court order is reunification, even though TPR hearing was held and judge was to make decision soon. Month comes when my ICPC paperwork is expiring, boys are 15months old, I find out foster parents put in petition to intervene, so I find lawyer in IA and we file our own petition to intervene. Parents rights are terminated when boys were 14months old. Now the boys are up for adoption and we have to do ICPC paperwork for adoption so more paperwork home study again. Since we have filed the intervening paper, we have been flying back and forth to IA once a month to visit with boys, I have seen the boys before when I flew to Iowa for 3 court dates. Now I find some information about foster parents that boys are with and first foster parents they were with for 5months, they are close friends and the FP that want to adopt boys have been in contact with boys from 2 weeks after they went into foster.The FP have a milestone calender and it shows that they have been to doctors appt and daily activities before they were placed in there care. We are waiting for my ICPC adopt papers to get to IA so we can have a adoptiion interview and FP will have one too. Then the adoption committee makes a choice as to who adopts boys. There is also a court date for guardianship which is scheduled for after the adoption choice.
My question is can I sue DHS, and both foster parents based on all evidence I have that the FP have had a plan from the start and the casework was pushing me off and placed the boys in foster/adopt home knowing that family has been involved from the begining and wants to take the boys? Do I wait to go forward with suing DHS till after the adoption interview or do I go above to supervisors and directors and let them know what is happening, do I tip my hand to FP lawyer or should I wait? With placement of boys through ICPC do they have to wait for termination or can they be placed before termination? How are foster parents picked and what child goes to who? When they went for a permancy plan and moved boys to foster/adopt home should they have been placed with us first since we are family and ICPC was filed? Also during hearing for removal of boys, the boys father (my nephew) told the judge that he has aunt and uncle in NY who can take the boys, then he said it again during TPR trial.
Thought out this whole time my nephew have been in 2 foster homes, when I believe they should have been with family. I believe both FP and casework had an agenda from the beginning.
Can someone give me some guidance on this whole case and what you think
