My daughter is five and is starting kindnergarten this fall. For the past four years her father and I have shared 50/50 custody and placement. Her father has made numerous attempts to gain sole custody and placement without success. Currently he is attempting to gain sole custody and placement before the school year begins. I am requesting joint custody and primary placement with periods of placement with her father. We live in neighboring states, about 2.5 hours away from each other. My question is related to the establishment of paternity and the location of such:
Paternity was established in the county I currently live in. All court hearings have taken place in the county (and town) that I have lived in since right after my daughter was born. It is a small, mostly rural area. We have one presiding judge. Is it very unlikely that the court would grant my daughter's father's request as he lives out of the state? For some reason, I think I was told that the courts prefer to grant placement where paternity was established, but I can't remember where I heard this....
Obviously, I understand that there are other issues that are taken into consideration.
