my grandfather was just found incompotant after having a stroke. and now my mom and her brother, who are both listed as power of attorney, are fighting over were he should live. either a move to Idaho with my mom. or stay in Arizona with her brother. what i need to know is if they can't come to agreement what kind of legal actions can be taken by either party to determine where he will live.
 
If they are unable to agree, the obvious option is a lawsuit.

Idaho is very beautiful.

Arizona is very beautiful.

Idaho can get very cold.

Arizona often stays warm.

I suggest you have mom and her brother ask for a medical opinion. See what a gramps' physician has to say. Ask the "doc" which climate would be better for gramps' health and well being.

If it were my pawpaw, I would avoid a court battle and do what is best for gramps!!!
 
well either climiate would be okay medically. this issue is time my mom is on disability and is willing to spend and has all the time in the world and is willing to spend it all with her dad. while on the other hand her brother works upwards of 80 hours a week and feels that since he has dementia time isn't an issue since he doesn't realize you are there half the time anyhow. so if this went to court what sort of things would they look at.
 
Well, that is very hard to say.

A court would look at which person is physically, financially, and mentally able to care for gramps. The fact that your mom is disabled could work against her, especially caring for an elderly person with dementia. That can sometimes be physically challenging.

People with dementia van sometimes get combative. They often require others to lift them, clean them, etc...

Again, I suggest mom and Unc discuss this with pawpaw's physician. They should also speak with a family counselor or therapist. Otherwise, get ready to do battle in court.

From what you say, Unc, just might start from a stronger position healthwise and financially. Good luck to you all.
