I need some advice as to whether or not I can get temporary custody over my three year old nephew. My sister is addicted to prescription drugs and my nephews father is an alcoholic. The police were called last night and told them that if they had to come out one more time; CPS was going to come get the child. I have pretty much raised the child since he was born until they moved away (the father is in the army). I am sincerely worried that my nephew is not getting the care that he needs. I am nineteen years old and I have a job that brings in a steady income. I do still live with my father but only because I'm trying to save money right now. My mom can't afford to take care of my nephew and my dad doesn't have time to give him the care that he needs, but I do.

If the child isn't being taken care of, you need to call CPS yourself.

If they do not see fit to remove the child, you won't get custody - period.

(And even if they do, you may have an uphill battle)

A call to dad's commanding officer or 1st SGT might get the army to investigate dad.

The military takes a dim view of soldiers not doing right by their dependents.

What Army Judge has suggested is honestly the best route to go. The military will respond quickly. This could also help the father of the child as well. They may be able to get his life turned around.
