I live in Tampa florida. My sister wants to give me custody of my nephew ( her child ) . She now has 50/50 custody of the child with the father. The father does drugs. He can be drug tested and he will not pass. What will I go thru and what will happen if we try to go through with it and what do I have to do to go through with it?

You will be required to take all of this to court.
Sorry, using or abusing drugs is considered a disease.
These days, being a drug addict, and alcoholic, or any number of thinsg that others consider wrong; won't cause you to lose your parental rights.
If you are worried about the safety, well being, and welfare of ANY child' report the matter to the police or child protection services in your state.

Tell your sister, she won't be allowed to GIVE her relatives her children.
Children aren't puppies, kittens, or used clothes.
You can't just give away your children.

Children are not property to be given away. She can not override a court order granting her ex 50% custody either. If the child is in danger because of the father, and not all children with a parent who uses controlled substances automatically is, she needs to file for a modification of that order in court. If she chooses to let your nephew "visit" you during her 50% of the time, she may of course do so provided it does not violate the terms of her custody agreement.
