i have temporary custody agreement of my nephew. his mom is running from the law, moving state to state. can she lose her right to custody if she goes to prison? she has several criminal charges including drug charges
 
The only correct legal response is: "Maybe".

Well, okay I'll clarify. Obviously she'll lose custody if she's incarcerated, at least short term. But parental rights? That's a whole different animal.

Where is the child's father? Is this arrangement court-ordered?
 
Why is Mom running from law? Where is Father? Is your custody agreement thorugh courts? Too many questions with no answers right now. If you want custody of this child (sounds like good idea at this point) then you should consult an Attorney on how you can proceed to do this if possible
 
the dad is unkown because she was prostituting for her drug habit when the child was conceived. she signed the papers in front of a notary. but he doesnt want to go with her. he has said that he was guna tell about the times when she goes to drug dealers house and he would hide in the back seat and cover up so noone would see him he was so scared. he will be 13 on the 27th of this month

Oh well, she can have two more lovely children. The first two children probably hate her anyway.

Next time, make up a more believable fairy tale.

Those papers mean nothing unless a judge signed them.

Not a thing.

The child will probably end up a ward of the state; then you can put yourself forward to see if the state will accept you as a placement option.
 
I had to go today for school because no they wouldn't accept that paper and we called her on the phone and she agreed to abandonment so I could keep him
 
DO WHAT??? What fairytale story? Some people do have real stuff happen to them like this and if you don't understand that then too bad and HAHA she can't have any more children. You have some issues.
 
Uh...yeah, except for:

Seriously - you have nothing. You don't have custody, you don't have guardianship, you don't even have POA.

There's no "abandonment" to agree to.

I have no idea what you think is going on, but I can assure you, it has no basis in legal reality.
 
Karen- you should consider contacting child social services to get some assistance. If neither parent is around they may have no problem with the child being in your care, and they can assist with getting the kid into school and getting you on the right track for the legal documents you need.
