Customer won't pay invoice, who is liable??

Hello and thank you for providing a nice forum where I can ask this question.

My husband and I own a service related business, lawn care and landscaping.
A man named Rich called us and hired us to take care of what he presented as his lawn at his home. He presented himself as a married man with a wife living in the home.
He asked us to invoice him monthly, and bill him at the end of each month. He asked us to address his bill to his business name "so and so plumbing", which we did.
This was done on a verbal agreement, no contract, a handshake.

He will not pay the bill now after the work has been done. The woman who he claimed as "his wife", is not his wife, although she is the one who lives at the house where the lawn was cut. She claims no part in any of this, although she saw our crew out there cutting her grass, and she never told them to stop. Her answer is this, "Call Rich, you invoiced Rich, I have nothing to do with this."

We come to find out, that Rich doesn't even live at that house, and we have no adddress or phone number to reach Rich. All we have is the home phone number, which is her phone number.

I want to take her to court, because I feel it is her that is living in that home, we cut HER grass, she watched us cut HER grass, and I feel she is the one liable for the bill.

Could you give me any advice on what to do? It's like they were running a scam. She gets some fly by night guy to call us, sets up the agreement, then he disappears, we can't get ahold of him, and she claims she aint responsible for paying, although she is the one who reaped the rewards of getting the grass cut.

Can I take her to court?

You really need to find Rich and sue him AND the woman who got the benefit of your work.

So what you are saying is.... is the ONLY way I can take them to court, is if I take BOTH of them? Can I just SINGLY take the woman, who I already have her name and address and phone number?
Sorry to bother you again, i just really would like confirmation on that.

Although you had a deal with a guy called Rich and you were supposed to bill his company, I can't see how you can sue the house holder?
If you were to come around an cut my lawn and i had no agreement with you personally, to me thats a bonus and to you it is a loss because i have agreed nothing with you.

How do you know he was not working a scam on her? he may have been seeing her and telling her he was paying you? There is allways two sides to a story, If she is not forthcomming on how to contact "Rich" then book it down to experiance and move on.

What go's around comes around if you see anyone doing her lawn stop and ask who there contract is with and explaine your story, before long knowone will touch the place.

You are going to need to prove that the people at this house agreed to have the lawn cut. Your agreement was with Rich, not the people in the house.

So who is Rich? Does the women who lives there know who this Rich guy is? Could Rich be a neighbor who perhaps was fed up with the way the yard looked? does the plumbing company legally exist?

You could possible call the police and see if they will talk to her and if she will give the wereabouts of this Rich person.
