Given that we have no idea where you're located, it's impossible to say.

Very generally though - in the US at least - provided there are no issues with the other parent's fitness, you can give custody to the other parent if they're in agreement.

If child services were involved, or there HAS been an issue with the other parent's fitness to be a parent, my answer will change.
