This morning I was stopped at a red light and a state trooper turned left in front of my truck going the opposite direction from me. He made a U-turn and came up behind me. Two seconds after the light turns green he puts on his lights and pulls me over. He tells me I didn't have my seat belt on, but he never came from his car to my window to even check. I told him it was on and he said I put it on when he was turning around.

Obviously his camera would show me wearing my seatbelt and prove my case (to an extent). He didn't ask for my insurance so I walked back to my truck to put the paper away and he becomes irrate as if I were a criminal. So I calmly go back and stand where "He did not give me permission to move" from and tell him I was returning my insurance paper to my truck. I'm wearing basically a high school uniform(work uniform) so I figure he took me for being a young punk. He continues to yell at me as I look across the street at 3 kids waiting to catch the bus and their mother looking at me wondering what was going on.

How would I go about getting the video evidence for my case? Also any ideas that you may have for me going into court with this case would help. It's a $25 dollar ticket but the cop was unethical and gave me the feeling that he was a little prejudice. He is a prime example of what the police force does NOT need to hire.

You can seek any video through discovery. Whether the video operates before he manually activates it or turns on his overhead lights is questionable, so chances are good that there is no video prior to the stop. But, you can seek the video anyway.

I don't see where he did anything "unethical", so I assume it is his demeanor you had a problem with. For that, you can complain to the local state police office.

Thanks Carl.

I was trying to look up "La. R.S.32:295.1" to find out the exact law and from what I have found it states...
"A. (1) Each driver of a passenger car, van, or truckhaving a gross weight of six thousand pounds or less, commonly referred to as a pickup truck, in this state shallhave a safety belt properly fastened about his or her body atall times when the vehicle is in forward motion..."

I don't know where to actually look up the complete law and I was wondering if this is the law, I was not in forward motion at the red light when he saw me. When the light turned green and he was behind me I clearly had my seat belt on when in forward motion.

Also how do I find out of if the DA is even required to follow through with the motion for discovery in LA. The courts are a tight nit group around here that work hand in hand with the police so I doubt that I will even get a fair chance with this. It's guilty until proven guilty for the most part... Please help.

Would this be grounds for dismissal being as I was NOT in forward motion? Your help is appreciated a lot!
Thanks.

Your state does things differently than the rest of the country ... sorry, but I can't say how they will treat any of this.
