My jurisdiction is: iowa

My daughter was at a store in Iowa with boyfriend and two others boys. She knew of no plans to shoplift but the two other boys began grabbing items and cutting them out of plastic. Daughter saw boyfriend start to do the same and she went to him and grabbed him and told him not to do it. He dropped the item he had. They walked out of the store as did the other two boys who had items on them.

So the daughter and boyfriend walked out with nothing and she never made an attempt to steal. The four were caught and all detained for third degree theft. Does my daughter have any chance of getting off on this charge? All of the boys told the police she had nothing to do with it as well. Boyfriend is 18, other three are juveniles.

Thanks.

NO she does not. She had knowledge of the event and made not effort to avoid situation other than with BF. Had she walked away before they exited or left scene or even told store staff she would be ok. Email me as I know someone who is expert in this area and may give you better help
