I'm actually trying to help my girlfriend collect on back child support for her 3yr old daughter. We just tracked the father down and caught wind that he will be moving out of the country in the coming months. I'm just wondering if there is any laws in place in Idaho that would prevent him from moving until his child support is settled. In addition I would also like to know what the next step she should take is regarding enforcement of the child support order that is already in place. He is a construction worker who gets paid under the table and I'm told that some states will offer a contempt of court warrant if the support is not received. Is Idaho one of those states?
 
Most states will issue a warrant when someone reaches an arrears level but I am not sure what it is. Each state is different. If this guy is adament about not paying support then he might get away with it. If he is in arrears then his passport should be frozen, or if he has not got one yet, he will not be able to if he is arrears $2500.00 or more. Here is a link to it:

On another note, I do not know what kind of a relationship your GF has with this guy, but he is dad and he does have rights, so if she chases after him for money, he will likely want visitation. Does she want that? Sometimes its best just to let sleeping dogs lie. I am sure she deserves the money but she needs to know it is always possible he will file for visits with the child.

There is not alot you can do. He can move where ever he needs/wants too, and there's nothing you or anyone else can do about it.

Your g/f COULD try for contempt, but not much will be done there. As far as revoking anything, States like Wyoming have found that unconstitutional.

For contempt of court, your g/f must file a contempt motion and order to show cause. But, if your g/f has missed just ONE visitation, this would be opening a can of worms you and your g/f wont like.

If the two of you are living together, she may lose custody:
