I filed for divorce from my husband in Sept. '08. Since that time he has refused to leave the house and find another place to live. Not only is he not helping out with any bills, i.e. utilities, mortgage, etc., but he also is causing friction among our two children. That in turn is causing a strain on my relationship with them. He has stated to my attorney his desire of not ultimately wanting our house. So why is he still there, living scott-free? Is there any way to get this bum out of my house before the divorce is finalized?

He has as much right to live in HIS home as you do barring a court order stating otherwise. The only way to "get him out" is with a court order.
