Dealer not living up to contract

Bought a car in n.h and i live in Maine i have contract saying its 90 day bumper to bumper. Was driving car fine for about a week then brakes went bad called dealership they said bring it down told them its not safe to drive that far. So i talked to owner he said he would pay for repairs told him where i was taking it and he was upset make a long story short he never paid and stuck me with bill then later said all repairs must be made there per contract however no where on contract does it say that wondering what my options are already complained too the bbb. Attached is repair contract.

Complaining to the BBB is a waste of time and energy. They have no enforcement ability.

Your option is to pursue a remedy in court.

Forget small claims in ME, you have to chase the seller in NH.

Success is dubious at best, unlikely is more realistic.
 
I would bet the cost of the brake repair is less than the time and effort of pursuing this in court out of state. You need to decide if it is worth it before you do anything else.

No that they do not however at very least its a black mark on their record. I also made a complaint to n.h inspection people as car should never had a sticker on it.
 
If you drove the car for a week before there was trouble why would you think the inspection was faulty?
Inspections certify the current condition of the vehicle, not the future condition.

If it were me I would have the vehicle serviced locally, pay for it, then send a copy of the bill to the dealer with a copy of the warranty and see if the dealer will reimburse.

So long as the repair is reasonably priced and the receipt/work order is detailed, I would think they find it easier to honor your claim rather than deal with a potential lawsuit over a negligible amount.

One cause of tires and two brakes do not go bad that fast the brake pads was so worn that they had to have been bad when i bought it. Wow. If it's just worn tires and brake pads you were lucky to get him to agree in the first place. Those are things the buyer should inspect before purchase.

This is not a mechanical defect that would typically be covered under any warranty. I doubt you would be successful claiming this under warranty. Your best option is probably to be nice and kindly request the dealer reimburse your expense in full, or negotiate a lesser amount.

I do not see success for you taking this to court.
