Dealing with a bank hold/sneaky collectors/judgments/stipulations

Went to court regarding an old debt and had a judgment made at the time to pay the creditors who now handle the account a small amount of money per month. I made the first 3 months payments on time...or so I thought. The first month I paid by money order. I never received a receipt that the payment went through so I called the collectors up and was told I could always pay online. That sounded like a great idea. So, I used my debit card (I don't have credit, it's my bank account card) the next 2 months. Unbeknownst to me, Capital One doesn't allow any debts to be paid with a debit card. So my payments were returned to my bank.

I called them back. They denied that anyone ever told me to pay online since my debt is to Capital One and they don't take debit cards (even though I was told, it was the only way I even knew they had an online payment system!).

So, I was told my payments were in 'default' of my agreement (judgment) and that they alerted the banks in my area that if I put more than $1716 in the bank, they can take it. Anything under that and it is ok? This sounds really fishy.

Here is the deal though. I don't have a job. I am below poverty level. I am received Medicaid even. They asked me to fax them my Medicaid paperwork but at this point I am scared to give them any more information about me considering what happened with my bank account.

So, today I called because I came across some money. I asked if I was able to settle and pay to update the account (pay the last few months) would the 'default' be dropped. First the guy said yes, he would send me paperwork about the 'new stipulation agreement'. When I asked him again, 10 minutes later after making the payment, he then acted very wishy washy and said 'Oh, you will be fine as long as you don't put more than $1716 in your bank account'. He couldn't seem to tell me that the bank issue would be lifted!

I also asked if I was able to in the next few months pay off the entire debt what would happen. He told me that he would be able to take up to 15% off the full amount if I were to pay in full. But then he couldn't seem to agree that my bank account would return to normal (which it should!).


Am I completely being messed with here? Am I in deep trouble? These people have my bank account number. I think they claim they want my Medicaid paperwork to see that I really am low income/poverty level but then who knows? Is there any way to renegotiate? What should I do?
 
I don't know what is going on. Any deal you make you MUST get in writing and it MUST say that payment of the amount is payment in complete satisfaction of the debt. The problem with knowing your banking information is that, if they obtain a judgment, they may be able to freeze your account. Negotiation is difficult unless you can make a reasonable payment that you think they might accept as payment in full. Otherwise, why wouldn't they sue you and wait to collect if they aren't receiving sufficient money for an oustanding loan?
