My father died 04/14/2016. I am his only child and was left out of will. Yet, my Aunt & Uncle decided to not probate will and let me have his stuff. But, his name was not on my birth certificate and I have no other relatives to compare DNA. His brother and sister are only half siblings. If I don't prove I am his only child and get a lawyer, all of his worldly possessions go to the mobile home park where he lived. This is due to a litigation of eviction of non payment of lot rent to owners. My father has all rent payments in bank, per his lawyers advice, since they refused to keep them cause' he was eccentric and weird. He had mental issues due to service and an accident. What can I do? Please I have nothing of my father's and they won't let me on th property to get anything and won't give me his used car that was given to me by my Uncle.

So, open probate yourself. That won't help you with anything that was in the will and left to others, or things which do not go through probate. If there are debts, the estate pays those first. Where is your mother in all this? A birth certificate is not the only way to prove parentage and it is rare that a DNA sample is the only proof someone is the parent of a child. I don't know your story but it would be worth you discussing it with an attorney who handles estates.
