My mother passed away in Dec 2006. She had no will and her house became the property of me and my sister. She is bi-polar and has slipped into her mood where she will not speak with me or the realtor the house is listed with. It has sat empty since my moms death.

We both owe the funeral home and the momument company. I am beside myself and do not know what to do. I work full time and live out of state. The house is in Illinois. We have had a good offer on the house, but since my sister doesn't like the person who wanted to buy it, she won't sell and that is when she cut off all communication.

Is there anything I can do? It seems like if she isn't willing to communicate/participate that I should have some legal ground to move this house on my own.

Please someone help me!!!!!

You will need to open a probate estate and have the personal representative sell the place and pay on the bills.

where to start?

You will need to open a probate estate and have the personal representative sell the place and pay on the bills.

So should I contact my attorney to get this moving? Does she have to pay 1/2 of what it costs to have this done or is it all on my shoulders?

I had to get an attorney when mom died because she wouldn't speak to me then either. She didn't help with any funeral arrangements or even attend the funeral. Therefore, money is definately an issue with me. It has already cost me more than it should have.

Thank you so much for such a quick reply. You are appreciated.
