My 24 year old son was killed on May 2 2009 in Georgia. His beneficiary was an ex-girlfriend in FLA who verbally promised (to many people) to 1) pay for his funeral expenses and 2)pay his MATCO TOOLS account; after 4 months she has ran away with the money and has paid nothing.
I believed his tool account was paid and approx. 2 weeks ago I sold his tools to go towards his funeral expenses. Last Thursday, I was contacted by MATCO TOOLS and was asked to give the tools back. I explained that I had only $587 worth of tools and would pay the balance of $320 at $50 per month; they were not satisfied as they would not give me the credit of $587 since the tools are considered USED now. I then stated I would keep all the tools and pay the $918 balance via $50 per month payments; they didn't like that either. They were more interested about their loss on the tools and not the loss of my son. Not to mention that the female that called me, the spouse of the vendor, screamed at the top of her lungs stating "I'll take you to court". My son was the one with the contract not me. I was willing to pay but "she" didn't want to wait the 18 months it would take me to pay off the $918. Being my son had NOTHING, there is no Estate, no Probate, no Executor. What are my rights, what am I looking at?
