Hello, I have been researching defamation for about 2 hours now a few things are not clear to me.

Those things are is it slander or libel if you directly say it to the person? what happens if its online place like a private facebook page where the user has to accept your "request" to be friends is that a private forum or a public one?

Is it still defamation if you said it right to the person? I will give you the story see below.

I live in Wisconsin and have had problems with my previous workplace and getting my checks so I ended up quitting (I did eventually get those checks with alot of hassle). That was in December and its now January so its tax season. I tried calling him asking him if he sent my W2 out or what was going on with it. Yes I know he has til the end of the month but I was curious if he was working on it or what. Well he never answered so I tried writing him on his facebook no answer, and then I tried calling again no answer, and I even tried texting him still no answer. This went on for about 2 weeks before I got sick of trying.

So tonight I decided that I would write on his facebook this exact thing.

"you could get back to me and quit acting like your six but judging from how you ran your business that won't happen."

He then called me and left me a voice messaging saying he was going to sue me for libel and Defamation of Character. I am wondering if you could tell me if that would hold up in court?

I mean from what I gather it would be hard to prove that its defamation because I used the words judging and that states an opinion.

What do you think?

Thanks for your time.

Oh good grief...he's blowing more smoke than a coal chimney.

Ignore him. NOTHING you have said could even come close to justifying a defamation lawsuit.

You have nothing to worry about. He is required by law to provide your W2 by the end of the month... if it doesn't show up then you can still file your taxes without it. There is a particular procedure to follow.

This isn't a case of libel/slander/defamation... don't worry about it.
