Defamation &wrongful accused

Defamation is frequently not an easy case to make. Just because you were arrested and perhaps even had the case dismissed does not mean that what was stated wasn't true. For example, you may have started a fight in a bar and arrested but the case was eventually dismissed because the prosecutor decided that there wasn't reliable evidence to convict you. In the case of a criminal prosecution, the burden is on the prosecutor to make a case against you. In a defamation case, the burden of proof is on you to prove that what the defendants alleged was false. The prosecutor dropping the case in the example didn't do so because of false allegations but as a result of not having enough evidence to make his or her case.

Typically attorneys will not take a defamation case on contingency. As a result, you might need to invest money to make money. I'm not sure that this is what you want to do. Think about whether this is worth your time. You may want to file your own case for an amount of damages and try to prosecute your own case and force a settlement out of the defendant. It may not be easy. As I don't know about the circumstances, I can't speak more on the subject but it is not always a simple matter. Best of luck to you.
