I had a roommate move out 6 months before the lease was up, I quickly filed a claim in small courts for her share of the rent money. The papers were served 2 weeks before she had to answer them. She did not answer the claim so i filed for a default judgement. Today i recieved notice she answered the claim the day after i filed for default judgement. Is there still a chance i will recieve a default judgement, or does the void the default judgement and I just have to appear in court now?

as far as i know, the default (clerk's judgment) can only be applied for after the time for the defendant's time to answer has expired. the defendant may still make a motion to vacate judgment (showing good cause), but, as far as i know, if the papers were not filed in time, the answer is moot. be aware that a motion to vacate may be filed and be prepared to answer/refile. i am not an attorney (yet)
