Our contractor installed a concrete driveway and walkway a year ago. Since then, the top layer has been pitting/scaling (big areas of about 2 feet wide).
He has since admitted that many other homes (over 30) where he installed concrete is having the same problems. He said the supplier supplied a bad mix.
He is currently being sued by 1 other person (so he says) and says that I am welcome to sue him, but that he would just file bankruptcy.
Is there any recourse on my part?
 
If he is not offering to redo the work with a different mix you don't have any other avenues but to sue him in small claims court.
 
You can ask when filing your suit if there are other suits for that contractor but I don't see what difference that piece of information will make on your case.
