Demanding Money While Threating Criminal Charges

I started with a small payday loan company in Nevada back in late April. On June 10th, I discovered I was pregnant. I wasn't planning on telling my boss until after the 1st trimester had ended. Between June 10th and mid July, my boss had made some illegal remarks about my weight. Saying that my body was an eye sore to her and the customers, that she wanted me to wear baggier clothes to work so I wouldn't offend anyone.

Right after July 4th, a nurse from the OB practice I was a patient with, came in to pay on her loan. Without asking, or even taking into consideration my HIPAA rights, she asks me about my pregnancy in front of my boss. So, not only did my boss find out from someone OTHER than me, but now she's angry that I didn't tell her myself. Between mid July and September 6th, my boss had made several more comments about my weight, plus she started in a few other infractions. She had started delegating tasks to me that weren't part of my job description. She also started changing her policies as she saw fit. For example, the financial institution clearly states that loans are due on the date posted, there are no grace periods. So, when a customer calls on the day their loan is due, and says they'll be in a week later, its unacceptable. However, she would only uphold that for certain customers, and then completely recant it for others.

On August 28th I had a job interview for an internship at another company. I got a call back from them on the night of September 1st asking me to come in for a second interview. Then I get a call the next morning telling me that they had changed their minds due to a less than satisfactory review from my current employer; said I was lazy, my work ethic had plummeted after I got pregnant, basically I was the worst employee she ever had. That was when I made the decision to quit on September 6th.

So, today, I discover that my SIM chip in my cell phone has crapped out and is preventing notifications of missed calls and voicemails to come through. I called my mom tonight only to find out that she tried to call me and couldn't leave a message because my voicemail box was full. I checked my mailbox and sure enough 13 voicemails I had no idea I had. I missed several calls, one being from my previous boss.

She tells me that a $650 payment has been deleted from the computer. Firstly, we have video cameras focused on the customer and cash areas 24/7. So, taking any money would be utterly stupid as the camera would see you do it. Secondly, we had to fax over copies of EVERY deposit we made that day, along with the daily reports showing money going in and coming out. Thirdly, she watches her bank balance, the deposits, and the daily paperwork like a hawk. Fourthly, she has a key logger on all computers logging every key stroke and mouse click made on each computer. Trying to sneak ANYTHING like that past her would be practically impossible.

So, back to her voicemail, she informs me that her bookkeeper had found that a payment for $650 had been deleted from the computer and that she was going to have a second bookkeeper look at her books for the month of August, but that if I didn't contact her immediately, she was going to involve the police; practically insinuating that she thinks I stole the money. Now, not only are her anti-theft practices extremely hard to get around, each of us in the office would double and triple check each others work every day for errors; just so we don't get railroaded for errors on the next yearly audit. I find it EXTREMELY suspicious that she is JUST NOW finding this error, conveniently 3 weeks after I quit. Especially after she accused me of taking kickbacks from our customers back on September 5th. I also know that she usually threatens court action with customers who are behind on their bills, to scare them into paying. So this feels like one of her scare tactics. Furthermore, if she had more compelling evidence, other than a deleted payment, that I took the money; wouldn't she just file the police report, rather than tell me she was going to do it first? But, given how insane this woman is, I don't doubt for one second that she wouldn't take this all the way just to get on top.

At this point, I am at a total loss and completely flabbergasted that she is pulling this crap. I know I didn't take the money, if the money is even missing to begin with. For all I know, it could be that the amount was mistyped into the computer and wasn't caught until after the payment posted, so someone deleted it to re-enter the amount. I am just lost for words.....this woman is still trying to mess with me even after I quit! I know I should speak to an attorney about this, and I plan to call one on Monday, but I don't know what I should do until then. I am so fuming right now I can't even see straight! I don't need this stress right now! What did I do to deserve this? Do I have any legal recourse I could take? I mean, would this be considered harassment, especially if she's just blowing smoke up my rear about getting the law involved? There has to be something I can do to put a stop to this woman!
 
If I were you, I'd focus on having a happy, healthy baby. That means you must take care of you.

As far as any lawsuit, maybe. As far as the right to sue anyone, at any time, for any perceived slight or affront, absolutely. Picking the prevailing party in a lawsuit is akin to picking the trifecta n the fourth race at the local horse or dog track; IMPOSSIBLE.

If you are innocent, as you assert, do nothing. You have nothing to fear. Let the police get involved, but don't answer any questions if they want to interview you. Stand on your right to remain silent, you aren't required to prove your innocence. The state has the burden of proving your guilt.

You're innocent until proven guilty before a court of law.
 
FYI, you are wrong that your boss's comment about your weight was illegal. Weight is a protected characteristic in the state of Michigan and a few isolated municipalities ONLY. (The District of Columbia protects personal appearance, which can include but is not limited to weight.) Comments on an employee's weight are rude all right, but they're not illegal outside those very limited areas, and even then only if there is adverse action taken against the employee because of it.
 
I agree. I don't see any unlawful activity by the employer described here. Maybe bit nice, but but illegal. I'm supposed weight is a protected characteristic anywhere.

The demand that you pay also is not illegal. In fact, it is how most collection attempts begin. You certainly don't have to pay if you don't want, and you certainly don't have to talk to the old boss or anyone else if they come asking questions.
 
I wouldn't do anything. (don't see anything illegal done by employer) If employer would get police involved (might not even happen), remain silent & get a lawyer.
