a person crashed in to the front part of my car. Nothing happen to the drivers door but could not be opened due to the ffront fender retracting. the tow truck took my car. the adjuster took pictures to my car and gave me a copy. there were no damages to the door. then the tow truck took my vehicle to the dealership to get it repaired and i took pictures of it as it arrived. there was a dent in the door because they forced it open. after that the dealership forced it again and made the dent worst, very noticeable. the dealership say the door was already like that and they made the damage worse. the tow truck is stating that it was the dealership and not them. I told them that i have pictures of the car when it arrived and they said i needed pictures of the car on top of the tow truck. they dont want to be liable.

Have you reported all of this to your own car ins. company?

Contact your insurance company, or the adjuster. Explain this to him, her, them. Ask them to help.

If the drivers compartment needed to accessed for towing purposes this would likely be considered collateral damage. The obvious question is if the door was not damaged and the fender was over it, how did the driver know this without opening the door into the fender and damaging it?
