My jurisdiction is: Texas

My landlord sent me a letter stating that they were keeping my $500 deposit and in addition are trying to charge an additional $190.

She is deducting for $300 for trash fees from the time that I moved in from November 2007 until I moved out in November 2008. Upon move-in, I had asked about getting trash service & she stated that everyone puts their trash out in the front of her house. I lived next door to her & she had another rental unit on the other side of her house. She never submitted a bill to me the entire time that I was there or verbally told me that I needed to pay a portion of the trash fee. The other renter has never paid a trash fee either. It was assumed that the trash fee was included in the rent. Can she deduct 12 months of fees from the deposit?

The other charges I can dispute because I took pictures before moving out.

If you dispute this amount, you write a letter to the landlord stating this and request that this amount (or the amount you think is fair) be returned to you within a certain time period (most people use five to seven days). Send it certified mail so that you have documentation they received this.

If they do not provide you with these funds, then your next step is to determine if you wish to file a lawsuit against them for this amount.

These lawsuits are typically handled in Small Claims Court where an attorney is not required by either party.
