Landlord says she has 30 days to return deposit. Time has passed she would not answer phone or return calls. After consulting with her partner she called upset that he had been called. When asked about the deposit was told she had not gotten any messages and she ha been out of the country(her voice mail was full). Again she was asked what about the deposit. Stated she did not have the new address to forward the deposit to. I offered to give her that information a second time. Stated she was driving, we could hang up and I could leave the information on her voice mail. Asked when could the deposit be expected. She would advise. Following day at 10am placed a call to ask if the information was received and it was. Again asked when was the deposit expected and she said she would have to call back her phone was having difficulties and she could only hear every other word I was saying. I waited until 530pm (CST) SHe would not answer the phone. I left a detailed message and asked if there was a problem I expected to hear back from her. I then called her business partner to advise what was going on, he in turn placed her on the phone , again she was upset that I had involved him. Stated she was going to allow me to vent and if she was not moving fast enougn for me then she would not dea with me. Well she was called the next day and spoke with my daughter and advised her that because of me she was going to take out for all the other little things that was not correct with the property and she would get the check in the mail on Thursday Oct 9th. However orginally she was only going to charge for the carpet not being clean. This property was vacated on Sunday, Aug 31th and the keys were placed in her partners hands on Tuesday, Sept 2nd. Due to them not being available to meet on Monday.
Now here's my issue with all this why was the deposit not given back at the time of move? Also she's keeping moniesthat she never replaced whatever she claimed, which don't know what that is?
This is not the first time this landlord has not given back tenants deposit and not answer her phone.
What can be done about this?
 
It would be useful if this site encouraged folks to post what state they lived in.

Just as states have differing time periods for the landlord to return the security deposit (or information as to why the full amount was not presented), there are differing penalties for missing this deadline.

In some states, failure to provide this information within the required time frame negates any charges for damages above normal wear and tear. Penalties in quite a few states also include the former tenant being able to sue for two to three times the intial security deposit amount.

If you'll list your state, we'll try to get you this information.
