I worked
For six months I was a cashier, then transferred to photo.
I was recently terminated because the manager (who has no photo lab knowledge) claims I did not shut down the photo printer the night before. I remember starting the shut-down process then having a customer come back to pick up his order, and going back to another software on computer to see if i can fix his picture, and then putting cameras away for the night.
Now that final day was a very emotional one. My dog had passed away, and they were going to move me to a cashier position temporarily. I was a little hurt by their decision, but understood. A few days ago, my coworker told me she overheard a conversation that this manager wanted me fired due to my calling out when my dog passed.
She would often look at my fingers. She would schedule me by myself on weekends for 3/4 of my shift when usually there were another associate that would come in when it was half over to relieve me for lunch.

Now I did have 2 write-ups prior to this...two being for reasons that I feel shouldnt have been..
1-
I had left a note for a coworker with my phone number and call me if you ever need to chat. My dept manager knew for a fact who this was intended to since she herself encouraged me to talk to him. She used this against me and brought it to an assistant manager. She first wrote me up for inappropriate behavior and then questioned the guy. He said he was always comfortable with me, didnt think there was anything wrong with what I did, and actually told management about the nice things I did for him when his dad passed.
2-I was written up for having more than 3 absences in a 6 month period. One of those absences was due to having Pneumonia. Even though it was not noted on that day that I had Pneumonia, I was on a LOA 3 days later because of being in the hospital with it.
3-Performing a mandatory weekly chemical testing procedure that resulted in a chemical leak in a bucket. I was not trained in but had to be done and there was no other associate/manager to do it since one was on vacation. I believe the leak happened because I could not close the valve properly due to the dexterity in my fingers. Management assumed I knew how to do this since I was in photo for 2 years. I'm part time and this was done by my department manager.

I am eligable for rehire in 90 days. But do i have a case for unfair termination

Also can applying for unemployment affect my chances of being rehired?

Please note that legally speaking, there is no such thing as an "unfair termination". Nothing in any law, anywhere in the US, requires that your termination be fair.

If you are asking whether or not your termination was wrongful, i.e. illegal, it was not.

There are no laws regarding rehire. As far as the law is concerned, applying for unemployment does not have anything to do with whether you are eligible for rehire or not. However, no law in any state in the US requires that your employer rehire you anyway. So it'll be up to your employer.

Now, if you had answered the question about what state you are in, we might have been able to give you more information. Since you didn't, you'll have to make do with this.

Agree, see no wrongful termination based on what you posted. Even if it was unfair -- unfair does not mean illegal.

Apply for UI & reapply in 90 days or look for other employment if you do not wish to work there any longer.

Are you trying to claim the manager has a finger fetish and looking at yours was sexual harassment? Otherwise, ya got nothing kid.
