Digital artist / freelance contract : Getting paid!

Dear Experts: I started a freelance gig as a digital artist in LA. I worked at this specific company for one week and two days, however things didn't work out after the 9 day ended; Friday night. I decided to leave/resign that weekend. (I had signed "their" deal memo/contract, however I turned it in and never saw them sign it nor got a copy before I left. (I know... HUGE! huge mistake! ) It all happened so fast- the hiring, the work, the issues and problems!; 9 days later,... I wrote a resignation letter on a Sunday, they responded that day with an Ok. Monday morning I cleared my desk and left. One BIG, BIG mistake on my part... I left without getting a copy of my Deal Memo/Contract ( I can just kick myself!) and have not spoken to them since. (Other than my letter sent to dismiss myself and the invoice)

In the resignation letter I had mentioned my remaining balance, and our initial agreement fee. Also, I have sent them an invoice for remaining 5 days of work. Now, two weeks later, no Check yet and I am a bit nervous about getting paid. I will call them soon but was curious....QUESTION: If they end up not paying me, can I still take them to small claims WITHOUT having the "Deal Memo"/Contract in my hands? I DO have copies of emails I sent, (NO Deal Memo pay mentioned in these) Two invoices, letters and a check/payment for the first three days of work. Are Emails, Invoices, letters and verbal agreements enough in place of a Deal memo/contract?

Thank You very much for listening and helping me!

Respectfully, Rick

Ps. As you can tell, I made some pretty horrible mistakes and without getting too elaborate; things didn't go well at all regarding the whole experience and especially with that company).

You can still go to small claims if needed, but you will have to prove your case somehow.

I don't believe they are obligated to pay you until the end of the normal pay cycle. If that hasn't happened yet then be patient.

Dear Mightymoose, thank you for responding. I will be patient and make small efforts to contact the company and get this resolved informally. However, If I do need to take the next step legally in small claims, do I have a "leg to stand on" so to speak, without the Deal Memo/Contract in my hands to prove my case? OR.... Coming prepared to prove my case with Invoices, Previous 'cashed' payment check, emails, Legal letters sent via USPS, collection/reminder letters, a Demand letter.

Cheers!

If you performed some kind of work then yes, you should expect to be paid for it.
How much you are to be paid may be in dispute without some kind of documentation, but yes, you have a leg to stand on to receive payment for several days work.
