Shoplifting, Larceny, Robbery, Theft Dinner Tab mistake....

So my boyfriend and I were asked to dinner by some friends of ours (a daughter and her mom) a few nights ago. They told us our dinner was going to be on them before we even left. We ate, had a nice dinner, and left. The tab came out to be 105. Around midnight that night they were still over at our house and the daughter's boyfriend called and said the police were there looking for her. She went home and found out that we apparently ran out on the check. She said she left the wrong card and it was a misunderstanding. The cop didn't care and was being a jerk (We live in oklahoma) and he wanted to see all of us, so he came over to our house and said we were all being charged with petty larceny. She contacted the establishment we ate at and told them the situation and paid the check in full with a 20 dollar tip. She contacted the court clerk and was told a warrant had already been issued for her arrest and so she went up today to talk to the judge. He told her there was nothing he could do and it would be up to the prosecuting attorney. She talked to him and he said he didn't care that it was setteled between the establishment and us and the charges were still going to stand. She is the only one who was issued a warrant so far but he told her we all would be getting issued one shortly. He gave her the option to sign a plea agreement with 700 in fees or go to jail today until the court date which is november 30th. Apparently the same will happen for all of us when we are issued a warrent. They're going to mail it to us and if we don't turn ourselves in then they will come to get us.

So I guess my question is can they do this? Is it legal? Or are we really even at fault? And if so what are my options?
 
If they coudn't do it they wouldnt have. You best action is to not talk to DA and consult an Attorney. Did you save your proof you paid in full? that might help as well. In meantime it might be best if you edit the name of establishment from your post. This site frowns on this action. Read the annoucement section to se why
 
its already been changed. thanks though. yes still got proof and the establishment is willing to help in anyway possible they said.
 
Consult a Lawyer and have further discussions with DA until you have done so. If contacted by Da tell them your not talking until you have consulted an Attorney
 
If there is no victim, then charges cannot go forward. If there is no one from the restaurant to testify against you, then you will be good.

First things first, consult an attorney.
