disciminating against kids

I have a nephew who is being held back from a field trip because he didn't pass a standardized math exam. this doesn't sound right and I did not know if there is recourse for him being punished for not being smart.
 
He's not being punished. He simply didn't get the reward because he didn't meet the requirements.

Nothing wrong with that.

And even if it was discrimination, it would not be illegal discrimination. Not being smart is not a protected characteristic.

This is one of life's tough lessons. He'll be okay if you support and encourage him. He's as smart as the next kid. He'll pass that test the next time. Tell him to work harder.

But it isn't about that trip. It's about learning math and doing well in school and life. There aren't any dumb kids or dumb people. He just has to study longer and try harder!

Why don't you tell him, you'll reward him with an outing WHEN he passes the test? :)
