Discimination and Review

I took a new job 4 month ago and while it started off well, later my boss became a jerk. It seems in the opinion of the American worked that he discriminates against us and holds us to another standard.

He has told me that he wanted to either hire and Indian or Asian with a green card or better yet, one trying to get a green card so he could control them. We are an American company own by and Israeli company. We sell technology to the DOD. We have lost contract due to our parent company being foreign.

My boss gave me a scathing review and brought in a list of all the tasks I was late on and other items. I never saw these items or the list before my review and was therefore unable to refute any of it. The president was also at my review.

The next day, the president told my boss to give me list (the president saw it an hour before my review). I responded to the lies and it escalated from there.
The other part of this is that 3 weeks earlier, I notified the president of the discrimination. We had a meeting about this after my review. He questioned 2 other employees and decided there wasn't enough evidence to consider our taking any action. What should I do?
 
It is not against the law to be a jerk.

Do you have any FACTS (not conclusions) that your boss is discriminating against you for your race, religion, ethnic background, sex, or national origin?
 
I don't know what you mean by FACTS. Please provide me with an example. Not many boss provide direct proof. You see this all the time with age discrimination. People don't say you old, you have to prove you were passed up for a job. I have seen a different standard. I was blind-sided in my review. This was not done to anyone else. Also, one american employee was re-review after 3 months (an american) when other who has similar or worse problems were given a pass since my boss said they worked harder.
