Discovery in small claims

I have requested discovery (documents and list of witnesses) from plaintiff in writing and in person. Plaintiff has refused to supply any claiming she does not have to, even after I cited the statute. Court trial is 10/24/07. Should I notify the Court or appear at trial and present at that time?

Have you checked with the clerk of court to see if discovery is allowed? In many states it is not available at the small claims level. Even if it is you have to file your request with the court and have it properly served.

Thank you for your response. I'm located in Wisconsin and have had success with filing for demand for discovery in small claims before. This is the first time I've been denied same.
