Discrimination Against Smokers

Is it legal for a fire chief to inact a rule that has not been adopted by the village itself that states smokers will not smoke while on duty. I know that you need to be 15 feet away from an opening due to new Illinois law, but to not to be able to smoke at all. Is this discrimination against those that smoke?

Although there are states where smoking/not smoking is a protected category, Illinois is not one of those states. So while it is discrimination, it is legal discrimination.

On reading your post again, I want to clarify. There is NO state where an employer is required to allow an employee smoke breaks or the right to smoke while on duty. What you are describing is legal in all states.
