You don't need a reason to sue, just the filing fee.
On the other hand, you need more than a reason to sue, you need a case (if you want to win)!!!
In your scenario, even if the person was a convicted felon, they wouldn't have a case.
Convicted felons aren't members of a protected class.
Wisconsin changed their law last year making it against the law to discriminate against a felon - we are actually being sued for preventing a person from getting hired because they told us they had a felony and we said that we could not move forward in the interview process. We just found out though that this person does not have a felony but instead has a Non-traffic Ordinance Violation severity Forf. U. So I am wondering since this person is not a felon would this then become a non issue.

The state can't require you to hire felons, when they won't hire people who have suspended drivers licenses for some of their positions.
It simply states the obvious.
You have to be fair in hiring people.
But, you don't have to say, we can't hire you because you're a convicted burglar. Or, we don't hire convicted child molesters to work in our day care center.
You simply say something like this, "Mr. Jones, your credentials are impressive. But, we've decided to hire someone else for our receptionist position. We will keep your application on file, for any future opportunities. Feel free to check back in a few weeks, if you don't hear from us. Bye, bye."
Honestly, would you hire someone as an armed guard who served 15 years for bank robbery? Neither would the state hire them as a state trooper!!!!
