Hi, I Am I Am Going Through Some Serious Issues On My Job At The Prisin Where I Work. To Make This Short And Simple, I Have Been Dismissed From My Job Because I Have A Health Issue With My Back And Hip. I Can Still Work And Have Been Until I Was Dismissed. My Doctor Had Me On Light Duty. I Work At A Prison So Because Of My Condition I Am Not Able To Work In The Dorm, But The Controlroom Booth Works For My Health Issue. Well I Am Black And There Is A White Female And Male That Have A Disability And Have Not Been Dismissed And Are Working As Always On A Light Duty Post Because Of There Health.i Wrote A Grievence In Feb. 2009 And The Commissioner Of Djj Has Not Responded Yet.i Have Now Wrote Eeoc To File A Claim Which I Was Told Today They Where Processing My Paperwork This Week So They Can Begin Investigation. I Was Forced To Use All My Leave Time In Order To Get A Pay Chech. As Of This Week All My Leave Is Gone And After 6-13-09 I Will Not Recieve Another Paycheck. I Dont Have Any Other Income. Im Wondering Could I Recieve Unemployment Benefits Right Now While My Case Is Under Investigation Even Though I Have Not Been Terminated By The Employer Yet. Also Do You Think I May Even Have A Case To Sued.

To answer your one question yes you can file for unemployment. As far as the discrimination issue contact an employment attorney, irregardless of the EEOC complaint.
