Dismissal of Citizen Complain

My son was involved in a minor motor vehicle accident. We was pulling out of his parking space at a very populated store and struck another vehicle. The owner of this vehicle jumped out of the car and started screaming at him. My son did not realize he struck this man's car(GMC Yukon) as it was much larger than his(ford ranger), so he thought that he was in this man's way and that was why he was screaming at him and pulled out of the parking lot. When stopped at a red light, my son noticed this man behind him beeping his horn and cursing at him, etc. So he sped away. He pulled in at his job and went to work. Before long a police officer showed up and advised him that he was in a motor vehicle accident and that he had left the scene of an accident, my son was stunned, wih this and apologized to the officer. The officer gave him a lengthy speech and decided not to issue any summons but that we were responsible for the repairs. A few weeks went by and we received some complaints in the mail which we were told were issued by the other motor vehicle driver (citizens complaints)which my son had hit. So...we went to court, when we got there the Judge said is there no way you can work this out. The driver then claimed he couldn't get my insurance company to pay the damages, and I said not possible. we were allowed to convene in a conference room where we agreed if I could get the matter straight with the insurance company within 24 hours he would drop the charges. All agreed. The insurance matter was resolved within 24 hours and his car was prepared. 5 months later we get a new court date in the mail, he calls us and tells us they won't dismiss the case. Is he bluffing? what can we do to dismiss this? Thoughts and suggestions appreciated.

You don't do much of anything to dismiss it.... you show up to court at the appointed time and provide evidence of the agreement that was reached and proof of payment to the other driver.
It sounds as if the insurance company either did not pay or did not pay entirely. If the other driver ended up using his own insurance then he may be suing to recover his deductible or other expenses.
