Disputing move out charges

I moved out of an apartment I lived in for six years last February. My living situation was never healthy, but I had no money to move. The apartment I lived in had a leaking garbage disposal that was damaging the cabinets. I put in many work orders to fix it and they never did. This was just one of the problems. I finally moved out and was never allowed a walkthrough of the apartment with office management.

I then get a notice that I owe them $1269.68 in damages. Among the charges were $450 for paint, $375 for countertops, $150 cabinet damage and other outrageous misc. charges. I immediately sent a certified letter asking for a detailed written report with copies of the receipts for charges. I asked for detailed receipts of every charge and areas cleaned and hourly costs. They sent me two receipts for the painting and the countertops that were very vague and did not match any amounts I was charged.

I immediately wrote back asking for more information and then informed them of my disputes. I got no response. Two months later I sent the same letter certified indicating that it was the second time I was sending the same letter with an immediate response requested. I got no response. Now, almost five month later I received a letter stating that their previous efforts to resolve the outstanding balance, (which is now the higher price of $1345.14) were ignored and that they are forwarding my account to a collection agency.

I have certified mail proving that it was not ignored, but in fact, they did not respond to me.

What should I do?

Information on your security deposit needed to have been sent to you within 30 days of your vacating the premises. If this was sent to you and follow up information was sent regarding countertops and painting, management may have felt they complied with your request and that they were under no further obligation to provide you with more detailed information.

If the information regarding your security deposit was not received within the legal required time, you can consider a lawsuit against them.
